Securitization companies, funds holding credits owed by individuals, credit-rights investment funds, and any other assignees of credits are also considered creditors (art. 2, § 1).[3]

The FGO could directly contract, without a bidding process, an entity to operate the program, paid exclusively by the creditors, with charging debtors prohibited; according to a Ministry of Finance note, B3 was the operating entity.[4]

Reshaped under Lula · Third term (since 2023) · since 2026

What was established

According to Agência Câmara, President Luiz Inácio Lula da Silva signed into law, without vetoes, the bill that creates Desenrola Brasil, converted into Law 14,690/23.[12]

Law 14,690 repealed Provisional Measure No. 1,176/2023 and validated the regulations, transactions, and acts carried out on the basis of it.[13]

How it works

In Tier 1, the credit operations had interest of at most 1.99% per month, a grace period of 30 to 59 days, a term of 2 to 60 months, a minimum installment of R$50.00, and amortization by the Price Table (Tabela Price).[14]

The Tier 1 financial agents could request a guarantee from the Operations Guarantee Fund (FGO), limited to the principal of the debt and to R$5,000.00 per debtor, with the reduction of this cap allowed in order to serve the largest possible number of debtors.[15]

In Tier 1, the law set the rules of the competitive process: holding an auction in electronic form, using the highest-discount criterion; establishing mandatory minimum discounts for each lot; and grouping the debts eligible for renegotiation by Individual Taxpayer Registry (CPF) number.[16]

In Tier 2, the law allowed the qualified financial agents that renegotiated debts to calculate presumed credit, in the manner provided for in the law and in a limited total amount, from calendar year 2024 through calendar year 2028.[17]

The law provided for a digital platform accessed with a gold- or silver-level gov.br account, with a financial education course, and required Caixa and Banco do Brasil to provide free in-person instruction, at all branches, to those who had difficulty accessing it.[18]

Financial institutions with a volume of funding above R$30,000,000,000.00, in order to participate as creditors in Tier 1, had to permanently delete default records of R$100.00 or less.[19]

Tier 1 credits honored by the FGO and not recovered had to be auctioned by the financial agents within 12 months; after the last auction, the portion subrogated to the FGO that was not sold would be considered extinguished.[20]

Debts outside Tiers 1 and 2 could be settled through the platform until December 31, 2023, in free negotiation and without the FGO guarantee.[21]

Who it serves

Tier 1 covered private debts of people listed in defaulter registries by December 31, 2022, with an active record on June 28, 2023, with monthly income of up to 2 minimum wages or registered in the CadÚnico; it excluded debts with collateral, rural credit, and real estate financing.[22]

Tier 2 covered the renegotiation of private debts of individuals listed in defaulter registries by December 31, 2022 and with an active record on June 28, 2023, with a debtor whose monthly income was equal to or less than R$20,000.00 (twenty thousand reais), a credit operation contract date through December 31, 2023, and a minimum payment term of 12 (twelve) months; it excluded debts that have a guarantee from the Union or a public entity, have any type of provision for contributions of public funds, or any equalization of interest rates by the Union.[23]

According to the Ministry of Finance, Tier 1 encompassed debts listed as delinquent between January 2019 and December 2022, of up to R$20 thousand each in updated value.[24]

Governance

Federal bodies and entities had to share with the operating entity and the financial agents the data needed to verify requirements (including income), validate information, and prevent fraud, with the data subject's prior consent waived.[25]

In the mode created by MP 1,393, the Ministry of Finance may contract, without a bidding process, Banco do Brasil or Caixa to operate the competitive procedure and manage the acquired portfolios, and those banks as the financial agents of the installment plans.[26]

Changes

Provisional Measure No. 1,199 of December 11, 2023 gave new wording to Law No. 14,690 so that Desenrola Brasil would last through March 31, 2024, with the exception of item II of § 2 of art. 16, and repealed § 2 of art. 12 of Law No. 14,690 of 2023.[27]

In the mode created by MP 1,393, the credits eligible for acquisition must meet criteria such as debts in default for more than seven hundred and twenty and less than one thousand six hundred and forty-five days, counted from September 25, 2026, and defaulted debts with an original value of less than R$10,000.00 (ten thousand reais), with the provisions of § 3 excepted in both cases, and a minimum discount of 90% (ninety percent) off the face value of each portfolio offered; the debtor may settle the debt in a lump sum with a discount equivalent to up to the same discount obtained in the acquisition of the portfolio.[28]

Law No. 14,995 of October 10, 2024 authorized the transfer of funds to the FGO, under the Programa Acredita no Primeiro Passo, with the redemption of shares corresponding to amounts not used to guarantee operations with FGO funds referred to in the caput of art. 10 of Law No. 14,690 of October 3, 2023, not including the funds committed to honoring the operations contracted up to the date Provisional Measure No. 1,213 of April 22, 2024 came into force, nor those needed to cover the operating costs of the FGO Desenrola until its closure; the same law provided that, to cover the operations contracted under Procred 360, the FGO will use funds not used to guarantee the operations referred to in art. 10 of Law No. 14,690.[29]

Budget and spending

Figures are nominal unless stated otherwise. Announced, authorized, committed, liquidated and paid amounts are different things and appear with the type indicated. In SIOP lines, "paid" means paid within the same fiscal year (arrears settled later are not counted), and one budget action can fund more than one program: the text says when the action is only part of a program.

According to the Statement of Reasons of MP 1,176, the Tier 1 guarantee would use funds already available in the FGO Pronampe (Law 13,999/2020), so that the program would not require additional contributions of public funds to the fund.[30]

The Statement of Reasons reported that Tier 2 does not generate revenue waiver in 2023 and recorded BCB estimates of a tax waiver of R$19.4 million in 2024, R$7.8 million in 2025, and R$12.6 million in 2026.[31]

According to the Ministry of Finance, R$1.7 billion of the R$8 billion reserved for the FGO as a guarantee was allocated to Desenrola, an amount to be used only in case of default on the renegotiations; the remainder could go to other policies.[32]

According to the Ministry of Finance (February 2025), the government allocated R$1.5 billion in guarantees to banks using remaining FGO Desenrola funds, for Procred 360 credit to small businesses.[33]

In the technical note on MP 1,176/2023, the Conof assessed that the Faixa 1 rules do not have an impact on federal revenues or expenditures because the FGO guarantee would use part of the fund resources already available for Pronampe, with no additional public resources contributed to the fund; and that the presumed credit of Faixa 2 translates into a tax-related benefit that gives rise to revenue waiver, assessable from 2024 to 2028 (analysis by the advisory office, of June 12, 2023).[34]

In the technical note on MP 1,211/2024, the Conof assessed that the extension of Faixa 1 would not have an impact on federal revenues or expenditures because it would be made possible with resources already available in the FGO (analysis by the advisory office, of April 2, 2024).[35]

Beneficiaries

Annual flow, a monthly stock and a cumulative total cannot be added together.

According to the Ministry of Finance, Desenrola Brasil benefited 15.06 million people with the renegotiation of R$53.07 billion in debts, an amount that corresponds to 0.5% of GDP (cumulative from July 2023 to May 2024).[36]

According to the Ministry of Finance, Tier 1, begun in October 2023, benefited a total of five million people with the renegotiation of R$25.43 billion in debts.[37]

According to the Ministry of Finance, Tier 2 (direct negotiation with the banks, income of up to R$20 thousand) benefited three million people with the renegotiation of R$26.5 billion in debts; the tier ended at the end of December.[38]

According to the Ministry of Finance, the program began with the main banks automatically removing 10 million records of debts of up to R$100 from the defaulter registries, totaling about R$1 billion.[39]

According to the Ministry of Finance, there were renegotiations in 5,567 of the 5,571 municipalities with an eligible public; in Tier 1, women were 52% of the eligible public and 56% of those who negotiated on the platform.[40]

Deliverables

Announcement, contracting, completion and operation are different phases.

According to the Tier 1 census released by the Ministry of Finance, the average discount on the site was 90% for lump-sum payments and about 85% for installment payments; the installment renegotiations had an average of 13 installments and average interest of 1.82% per month.[41]

According to the Ministry of Finance, access to the platform, initially restricted to gold- or silver-level gov.br accounts, was opened to the bronze account, and the ministry regulated partnerships for access through the channels of Serasa Limpa Nome, Itaú Unibanco, Santander, and Caixa.[42]

Observed results

A result observed during a term may have causes other than the program.

The Ministry of Finance cited a Serasa survey according to which, from May 2023 to March 2024, the number of defaulters with the profile and debts of Tier 1 fell from 25.2 million to 23.1 million (a reduction of 8.7%), while in the general group of defaulters, excluding Tier 1 beneficiaries, there was an increase of 6.8%. The comparison is not a causal assessment.[43]

Limitations

The Central Bank data on Desenrola do not include renegotiations not eligible for the program, even when offered on the same terms, and, for the reference date of September 2023, accumulate operations from September and earlier months.[44]

In announcing the Novo Desenrola Brasil in May 2026, the Ministry of Finance reported that household default had reached 5.3% in March 2026.[45]

Context

Law No. 14,995/2024 instituted Desenrola Pequenos Negócios, intended for individual microentrepreneurs, microenterprises, small businesses, and cooperative societies, with the aim of encouraging the renegotiation of debts of companies with annual gross revenue equal to or less than R$4,800,000.00; the financial institutions that renegotiate these debts by December 31, 2024, except credit unions and consortium administrators, may be entitled to calculate presumed credit.[46]

According to the Ministry of Finance, Desenrola Pequenos Negócios made possible the renegotiation of R$7.5 billion in bank debts of about 120 thousand MEIs (individual microentrepreneurs), microenterprises, and small businesses between May and December 2024.[47]

Provisional Measure No. 1,355 of May 4, 2026 instituted the Extraordinary Program for Households' Financial Rebalancing - Novo Desenrola Brasil, for individuals with monthly income equal to or less than five minimum wages who, among other requirements, have credit operation contracts entered into by January 31, 2026 and installments overdue between ninety-one and seven hundred and twenty days, with a new operation at a maximum interest rate of 1.99% per month, a term of twelve to forty-eight months, an amount of up to R$15,000.00 per beneficiary and per financial institution, and an initial offer period of ninety days, counted from the date of publication of the Provisional Measure.[48]

According to the Ministry of Finance, the Federal Government announced on May 4, 2026 the Novo Desenrola Brasil, the 'second edition of the program that has already benefited about 15 million Brazilians since 2023', with the renegotiation of about R$53 billion in debts; MP 1,355 establishes the Extraordinary Program for the Financial Rebalancing of Families - Novo Desenrola Brasil.[49]

MP 1,355/2026 authorized the Union to increase its stake in the FGO by up to R$5,000,000,000.00 to cover the debt restructuring operations provided for in the measure, and ordered the transfer to the FGO of the 'amounts to be returned' from the Amounts Receivable System (Sistema de Valores a Receber) reported by December 31, 2024.[50]

Provisional Measure No. 1,373 of June 29, 2026 established the Desenrola Adimplentes and authorized the Union, subject to budgetary and financial availability, to allocate up to R$3,000,000,000.00 to a reimbursable credit line for beneficiaries of the program, who must, among other requirements, not have an active formal employment relationship; the financial agents are Banco do Brasil S. A. and Caixa Econômica Federal (Caixa).[51]

In SIOP, for the current fiscal year 2026 (partial figures), action 00YH (Financing for Beneficiaries of the Desenrola Adimplentes Program), of the unit Resources under the Supervision of the Ministry of Finance, in the budget plan Provisional Measure No. 1,377 of July 16, 2026, had an initial appropriation of zero, authorized and committed of R$3,000,000,000, and liquidated and paid of R$1,650,000,000. The action finances the reimbursable credit line of the Desenrola Adimplentes, a program of its own established by MP 1,373/2026 for borrowers who are current on their payments.[52]

Provisional Measure No. 1,377 of July 16, 2026 opened extraordinary credit of R$13,285,000,000.00, which included R$3,000,000,000 in action 00YH (Financing for Beneficiaries of the Desenrola Adimplentes Program) and R$1,000,000,000 in action 00YG (Financing for Beneficiaries Who Are Current on the Student Financing Fund, Fies), both under Official Credit Operations.[53]

The same MP 1,373/2026 established the National Program of Financial Incentive for Timely Payment in the Student Financing Fund (Fies Empreendedor), with a reimbursable credit line for beneficiaries of Fies who are current on their payments, authorizing the Union to allocate up to R$1,000,000,000.00.[54]

According to its summary (ementa), MP 1,355/2026 establishes the Extraordinary Program for the Financial Rebalancing of Families (Novo Desenrola Brasil), provides for the transfer of resources to the Operations Guarantee Fund, and amends Law No. 12,087/2009, Law No. 14,467/2022, Law No. 14,509/2022, Law No. 13,999/2020, Law No. 10,260/2001, Law No. 8,213/1991 and Law No. 10,820/2003.[55]

According to the MEC (August 31, 2026), the Desenrola Fies 2026, a renegotiation of Fies contracts signed up to 2017, had a deadline for enrollment of August 31, considering the validity of Provisional Measure No. 1,355/2026; the MP amended the Fies legislation and set the renegotiation conditions, with discounts for debts that were overdue and unpaid as of the date of its publication.[56]

Provisional Measure No. 1,213 of April 22, 2024 established the Acredita no Primeiro Passo Program, amended Law No. 13,999/2020 to establish Procred 360, and established the Desenrola Pequenos Negócios (renegotiation of debts of MEIs, microenterprises and small businesses); the same program appears in art. 19 of Law No. 14,995/2024.[57]

Law 14,818/2024 authorizes the transfer, to the fund that finances the financial-educational incentive for high school, of amounts not used to guarantee FGO operations under Law No. 13,999/2020, as well as amounts recovered under art. 25 of Law No. 14,690/2023.[58]

Law No. 14,719 of November 1, 2023 amended Law No. 10,260/2001, on student financing, to allow students with debts that were overdue and unpaid as of June 30, 2023 to settle them by joining the settlement, with a discount of up to 99% of the consolidated amount of the debt for debts overdue for more than 360 days of those registered in the CadÚnico or beneficiaries of the 2021 Emergency Aid (Auxílio Emergencial), and of up to 77% for the others with more than 360 days.[59]

According to the MEC (September 3, 2024), the Desenrola Fies, a Fies debt renegotiation program for contracts signed up to 2017 and in default as of June 30, 2023, had 351,696 contracts renegotiated, with R$677 million returned to the public coffers, and more than 844 thousand students still eligible; the enrollment deadline was extended to December 31 of that year (data reported by the government).[60]

Methodology

The Central Bank publishes monthly, in CSV, aggregate SCR data on Desenrola operations (number and value after discount, by institution, state, and tier), excluding operations settled with the borrower's own funds at the time of renegotiation and those of clients with total debts of less than two hundred reais.[61]

Origin

Bill No. 2,685/2022, introduced in the Chamber on October 27, 2022 by Deputy Elmar Nascimento, proposed the National Program for Renegotiation of Family Debts (ReFamília), for families with monthly income of up to R$5,000.00, operated by a credit guarantee fund with participation of the Union.[62]

According to the Statement of Reasons of MP 1,176, signed by Minister Fernando Haddad, there were about 70 million defaulting Brazilians (approximately 42% of the adult population), of whom about 43 million were in families with income of up to two minimum wages.[63]

The Statement of Reasons describes the program in two axes: Tier 1, of operations with a guarantee, and Tier 2, of renegotiations based on presumed credit, with contracting through December 31, 2023.[64]

According to an Agência Câmara news item of October 4, 2023, the text of MP 1176/23, which would lose its validity on Tuesday (3rd), was included, after an agreement in the National Congress, in PL 2685/22, which dealt with limiting credit card interest; the Chamber records the status of the MP as 'Lost Effectiveness'.[65]

Precursors

The Statement of Reasons of MP 1,176 says that financial agents will be able to calculate as presumed credit certain types of credits arising from temporary differences, in a manner similar to that established by Law No. 14,257 of December 1, 2021, which instituted the Credit Stimulus Program (Programa de Estímulo ao Crédito).[66]

Responsibilities

The financial agents financed the renegotiations with their own funds, collected the defaulted contracts in their own name, bore the recovery expenses, and were answerable for the truthfulness of the information and the accuracy of the amounts reimbursed.[67]

  30. 30. According to the Statement of Reasons of MP 1,176, the Tier 1 guarantee would use funds already available in the FGO Pronampe (Law 13,999/2020), so that the program would not require additional contributions of public funds to the fund.

  31. 31. The Statement of Reasons reported that Tier 2 does not generate revenue waiver in 2023 and recorded BCB estimates of a tax waiver of R$19.4 million in 2024, R$7.8 million in 2025, and R$12.6 million in 2026.

  32. 32. According to the Ministry of Finance, R$1.7 billion of the R$8 billion reserved for the FGO as a guarantee was allocated to Desenrola, an amount to be used only in case of default on the renegotiations; the remainder could go to other policies.

  33. 33. According to the Ministry of Finance (February 2025), the government allocated R$1.5 billion in guarantees to banks using remaining FGO Desenrola funds, for Procred 360 credit to small businesses.

  34. 34. In the technical note on MP 1,176/2023, the Conof assessed that the Faixa 1 rules do not have an impact on federal revenues or expenditures because the FGO guarantee would use part of the fund resources already available for Pronampe, with no additional public resources contributed to the fund; and that the presumed credit of Faixa 2 translates into a tax-related benefit that gives rise to revenue waiver, assessable from 2024 to 2028 (analysis by the advisory office, of June 12, 2023).

  35. 35. In the technical note on MP 1,211/2024, the Conof assessed that the extension of Faixa 1 would not have an impact on federal revenues or expenditures because it would be made possible with resources already available in the FGO (analysis by the advisory office, of April 2, 2024).

  36. 36. According to the Ministry of Finance, Desenrola Brasil benefited 15.06 million people with the renegotiation of R$53.07 billion in debts, an amount that corresponds to 0.5% of GDP (cumulative from July 2023 to May 2024).

  37. 37. According to the Ministry of Finance, Tier 1, begun in October 2023, benefited a total of five million people with the renegotiation of R$25.43 billion in debts.

  38. 38. According to the Ministry of Finance, Tier 2 (direct negotiation with the banks, income of up to R$20 thousand) benefited three million people with the renegotiation of R$26.5 billion in debts; the tier ended at the end of December.

  39. 39. According to the Ministry of Finance, the program began with the main banks automatically removing 10 million records of debts of up to R$100 from the defaulter registries, totaling about R$1 billion.

  40. 40. According to the Ministry of Finance, there were renegotiations in 5,567 of the 5,571 municipalities with an eligible public; in Tier 1, women were 52% of the eligible public and 56% of those who negotiated on the platform.

  41. 41. According to the Tier 1 census released by the Ministry of Finance, the average discount on the site was 90% for lump-sum payments and about 85% for installment payments; the installment renegotiations had an average of 13 installments and average interest of 1.82% per month.

  42. 42. According to the Ministry of Finance, access to the platform, initially restricted to gold- or silver-level gov.br accounts, was opened to the bronze account, and the ministry regulated partnerships for access through the channels of Serasa Limpa Nome, Itaú Unibanco, Santander, and Caixa.

  43. 43. The comparison is not a causal assessment.

  44. 44. The Central Bank data on Desenrola do not include renegotiations not eligible for the program, even when offered on the same terms, and, for the reference date of September 2023, accumulate operations from September and earlier months.

  45. 45. In announcing the Novo Desenrola Brasil in May 2026, the Ministry of Finance reported that household default had reached 5.3% in March 2026.

  46. 46. Law No. 14,995/2024 instituted Desenrola Pequenos Negócios, intended for individual microentrepreneurs, microenterprises, small businesses, and cooperative societies, with the aim of encouraging the renegotiation of debts of companies with annual gross revenue equal to or less than R$4,800,000.00; the financial institutions that renegotiate these debts by December 31, 2024, except credit unions and consortium administrators, may be entitled to calculate presumed credit.

According to an Agência Câmara news item of October 4, 2023, the text of MP 1176/23, which would lose its validity on Tuesday (3rd), was included, after an agreement in the National Congress, in PL 2685/22, which dealt with limiting credit card interest; the Chamber records the status of the MP as 'Lost Effectiveness'.

  66. 66. The Statement of Reasons of MP 1,176 says that financial agents will be able to calculate as presumed credit certain types of credits arising from temporary differences, in a manner similar to that established by Law No. 14,257 of December 1, 2021, which instituted the Credit Stimulus Program (Programa de Estímulo ao Crédito).

  67. 67. The financial agents financed the renegotiations with their own funds, collected the defaulted contracts in their own name, bore the recovery expenses, and were answerable for the truthfulness of the information and the accuracy of the amounts reimbursed.
