Law No. 11,340 of August 7, 2006 (Maria da Penha Law)

- Problem
- Domestic and family violence against women. In 2001, the Inter-American Commission on Human Rights held Brazil responsible for the unjustified delay and negligent handling of the Maria da Penha case; according to the Statement of Reasons of the bill, 70% of the cases tried in the Special Criminal Courts involved domestic violence, and Law 9,099/1995 did not offer an adequate solution.
- Who it serves
- Women in situations of domestic and family violence, within the domestic unit, the family or an intimate relationship of affection.
- How it works
- Law No. 11,340/2006, enacted by the National Congress from a bill of the Executive Branch drafted by an interministerial group that received a draft proposal from the Consortium of feminist NGOs. It defines forms of violence, provides for urgent protective measures decided by the judge, and sets aside Law 9,099/1995, which the original bill had retained; the setting aside and the Domestic and Family Violence against Women Courts, which may be created by the Union (in the Federal District and Territories) and by the states, were proposed in the substitute text of rapporteur Jandira Feghali in the Chamber of Deputies. The policy to combat violence is a coordinated set of actions by the Union, the states, the Federal District and the municipalities, and of non-governmental actions.

Precursors
- Regime of Law 9,099/1995 (Special Criminal Courts) applied to domestic violence crimes, set aside by art. 41 of Law 11,340/2006 replaced Law No. 9,099 of September 26, 1995, provided for the Special Civil and Criminal Courts. In its original publication, the Special Criminal Court had jurisdiction over criminal offenses of lesser offensive potential, defined as criminal misdemeanors and crimes for which the law sets a maximum penalty of no more than one year, except where the law provides for a special procedure, and criminal prosecution for the crimes of minor bodily injury and negligent bodily injury came to depend on a complaint by the victim.[19]
- Draft bill of the Consortium of feminist NGOs (2002 to 2004) earlier technical basis According to the opinion of rapporteur Jandira Feghali in the Committee on Social Security and Family, the substitute text is the result of a process that began in 2002, with the formation of a Consortium of NGOs to draft a Domestic Violence Law, whose first version was presented in November 2003 to the Women's Caucus in the National Congress and to the Special Secretariat for Policies for Women.[20]
- Specialized police stations for women's assistance and shelters (before 2003) similar initiative, no succession stated by the source In an experience report by the Special Secretariat for Policies for Women published by ENAP, the Secretariat stated that the only policies aimed at women that existed before 2003 were the shelters (casas abrigo) and the specialized police stations for women.[21]

What was established
Art. 41 of Law No. 11,340/2006 established that Law No. 9,099/1995 does not apply to crimes committed with domestic and family violence against women, regardless of the penalty provided.[29]
How it works
The law defines domestic and family violence against women as any action or omission based on gender that causes her death, injury, physical, sexual or psychological suffering, and moral or property damage, within the domestic unit, the family or any intimate relationship of affection.[30]
The law lists as forms of domestic and family violence against women, among others, physical, psychological, sexual, property and moral violence.[31]
Once violence is established, the judge may apply to the aggressor urgent protective measures such as suspension of possession or restriction of the carrying of weapons, removal from the home, and a ban on approaching and contacting the victim, her family members and witnesses; once the request is received, the judge must decide within 48 hours.[32]
The law prohibited the application, in cases of domestic and family violence against women, of penalties of basic food baskets (cesta básica) or other monetary payment, as well as the substitution of a penalty that involves the payment of a fine alone.[33]
The law amended art. 129 of the Penal Code, setting for bodily injury committed within domestic relations a penalty of detention of 3 months to 3 years, and added the possibility of pretrial detention in the Code of Criminal Procedure to guarantee the enforcement of urgent protective measures.[34]
Changes
Law No. 13,505 of November 8, 2017, signed into law by Michel Temer, added to the Maria da Penha Law the right of women in situations of domestic and family violence to specialized police and forensic care, provided without interruption and preferably by female personnel.[35]
Law No. 14,188 of July 28, 2021, signed into law by Jair Messias Bolsonaro, defined the Sinal Vermelho cooperation program against Domestic Violence as a measure to confront violence provided for in the Maria da Penha Law and created in the Penal Code the criminal offense of psychological violence against women.[36]
The same Law No. 14,550/2023 added art. 40-A, under which the law will apply to all situations provided for in its art. 5, regardless of the cause or motivation of the acts of violence and of the status of the offender or the victim.[37]
Law No. 14,541 of April 3, 2023, signed into law by President Luiz Inácio Lula da Silva, provides for the creation and uninterrupted operation of Specialized Police Stations for Women's Assistance (Deam), including on holidays and weekends.[38]
Law No. 14,899 of June 17, 2024, signed into law by President Luiz Inácio Lula da Silva, determined that the states, the Federal District and the municipalities prioritize ten-year goal plans to confront domestic and family violence against women, making access to federal public security and human rights funds conditional on the regular submission of these plans.[39]
Law No. 15,212 of September 18, 2025, signed into law by President Luiz Inácio Lula da Silva, amended the summary of Law No. 11,340/2006 to officially name it the Maria da Penha Law.[40]
Budget and spending
Figures are nominal unless stated otherwise. Announced, authorized, committed, liquidated and paid amounts are different things and appear with the type indicated. In SIOP lines, "paid" means paid within the same fiscal year (arrears settled later are not counted), and one budget action can fund more than one program: the text says when the action is only part of a program.
The law established that the Union, the states, the Federal District and the municipalities, within the limits of their competences and under the terms of their respective budget guidelines laws, may set specific budget appropriations, in each fiscal year, for the implementation of the measures it provides for.[41]
According to the Secretariat's report, the Pact provided for resources on the order of R$1 billion for the period 2008 to 2011, to be carried out by various bodies; the amounts were preliminary and subject to change according to agreements and budget appropriations.[42]
Observed results
A result observed during a term may have causes other than the program.
According to Agência Brasil, with data from the Ministry of Women, Ligue 180 received a total of 568.6 thousand calls in 2023, and reports of violence against women rose from 87.7 thousand the previous year to 114.6 thousand in 2023 (service records, which do not measure the incidence of violence).[43]
According to the National Council of Justice, in 2024 there were 827,990 case movements related to urgent protective measures under the Maria da Penha Law and 959,228 new court cases related to domestic violence (court records, which do not measure the incidence of violence).[44]
Impact evaluations
Evaluations with a causal design are flagged; association is not proof of effect.
Ipea Discussion Paper 2048 (March 2015), by Cerqueira, Matos, Martins and Pinto Júnior, estimated a difference-in-differences model comparing homicides of women occurring in homes with those of men and concluded that the law played a relevant role in containing gender-based violence, although its effectiveness was not uniform across the country.[45]
Limitations
In an audit discussed in Plenary in November 2019 (Ruling 2,766/2019), the TCU found that, since 2015, successive changes had resulted in a reduction of 80% in the budget appropriation and of 42.3% in the staff of the National Secretariat for Policies for Women.[46]
The same Ipea study states that the effectiveness of the law depends on the institutionalization of protective services in localities, which occurred unevenly across the territory, and that the evaluation used homicides because of the unavailability of data on nonlethal violence against women.[47]
Context
In Report No. 54/01 (case 12,051, Maria da Penha Maia Fernandes), of April 4, 2001, the Inter-American Commission on Human Rights concluded that the Federative Republic of Brazil is responsible for the violation of the rights to judicial guarantees and judicial protection, through the unjustified delay and negligent handling of this case of domestic violence.[48]
According to Report No. 54/01, the complaint was received by the Inter-American Commission on August 20, 1998, filed by Maria da Penha Maia Fernandes, CEJIL and CLADEM, and concerned the violence committed by Marco Antônio Heredia Viveiros, which culminated in an attempted homicide and further assaults in May and June 1983.[49]
Among the recommendations of Report No. 54/01, the Commission asked Brazil to continue and intensify the reform process that avoids state tolerance and discriminatory treatment with respect to domestic violence against women, and to simplify criminal judicial procedures in order to reduce procedural time.[50]
Law No. 10,714 of August 13, 2003, authorized the Executive Branch to make available, nationwide, a telephone number to receive reports of violence against women.[51]
In the same session of February 9, 2012, by majority (Justice Cezar Peluso dissenting), the STF granted ADI 4424, filed by the Office of the Attorney General (PGR), holding that the Public Prosecutor's Office may initiate criminal proceedings without the need for a complaint from the victim, according to a news item from the STF.[52]
Law No. 13,104 of March 9, 2015, signed into law by Dilma Rousseff, amended the Penal Code to provide for femicide as an aggravating circumstance qualifying the crime of homicide and to include it in the list of heinous crimes.[53]
In the study's conclusions, the Ipea authors record that the drafting and enactment of the law involved the active participation of feminist non-governmental organizations, the Secretariat for Policies for Women, academia, legal practitioners and the National Congress.[54]
Origin
The Statement of Reasons of the bill records that, in March 2004, the Consortium of Feminist Non-Governmental Organizations submitted a draft bill proposal to inform the discussions of the Interministerial Working Group.[55]
According to the Statement of Reasons, the bill was drafted by the Interministerial Working Group made up of the Special Secretariat for Policies for Women (coordinator), the Casa Civil (Chief of Staff's Office), the Attorney General's Office (AGU), the Ministry of Health, the Special Secretariat for Human Rights, the Special Secretariat for Policies to Promote Racial Equality, the Ministry of Justice and the National Secretariat of Public Security.[56]
Statement of Reasons (EM) No. 016-SPM/PR of November 16, 2004, signed by Nilcéa Freire, Special Secretary for Policies for Women, submitted to the President of the Republic the proposed bill creating mechanisms to curb domestic and family violence against women.[57]
The Statement of Reasons of the bill cited Report No. 54 of the Inter-American Commission on Human Rights in the Maria da Penha Maia Fernandes case and its recommendations to the Brazilian State.[58]
In its original text, PL 4,559/2004 provided that Law No. 9,099/1995 would apply to crimes of the jurisdiction of the Special Criminal Courts involving domestic and family violence against women, insofar as it did not conflict with the new law.[59]
Rapporteur Jandira Feghali reported having taken part in public hearings in the Legislative Assemblies of Rio Grande do Sul, Minas Gerais, Rio de Janeiro, São Paulo, Rio Grande do Norte (joint with Paraíba and Ceará), Espírito Santo and Bahia.[60]
The same substitute text replaced the term precautionary measures with urgent protective measures throughout the bill, with the judge to decide on them within 48 hours.[61]
In the Chamber of Deputies, the opinion of rapporteur Jandira Feghali (PCdoB-RJ) with a supplementary vote was unanimously approved in the Committee on Social Security and Family on August 24, 2005; the Committee on Finance and Taxation unanimously approved the opinion of rapporteur Yeda Crusius (PSDB-RS) on November 23, 2005; and the Committee on Constitution, Justice and Citizenship unanimously approved the opinion of rapporteur Iriny Lopes (PT-ES) on December 13, 2005.[62]
Precursors
The Statement of Reasons of PL 4,559/2004 stated that 70% of the cases tried in the Special Criminal Courts involved domestic violence and that Law 9,099/95, not having been created for that purpose, did not offer an adequate solution.[63]
