National professional salary floor for public basic education teaching professionals (Law No. 11,738 of July 16, 2008)

Problem
Starting salary of public basic education teaching professionals. According to the Statement of Reasons of PL 619/2007, the National Pact for the Valorization of Teaching, of 1994, set a floor of R$300.00, in 1994 values. Law No. 11,738/2008 regulated subitem e of item III of art. 60 of the ADCT to establish the national floor.
Who it serves
Public basic education teaching professionals who teach or provide pedagogical support to teaching, in addition to retirements and pensions covered by Constitutional Amendments 41/2003 and 47/2005; in 2026, the law began expressly including early childhood education teachers and fixed-term contract teachers.
How it works
A law enacted by the National Congress originating in PLS 59/2004, by Senator Cristovam Buarque, considered in the Chamber together with PL 619/2007, from the Executive Branch, and approved in the Education and Culture Committee in the form of a substitute bill. It sets the amount below which the Union, states, the DF and municipalities may not set the starting salary for a workweek of up to 40 hours, with a limit of 2/3 of the workweek in interaction with students. The STF judged ADI 4167, brought by five governors, unfounded and fixed the law's effectiveness from April 27, 2011. MP 1,334/2026 began to provide for annual adjustment by the previous year's INPC plus 50% of the average, over the previous five years, of the real change in revenue from the entities' contribution to Fundeb, with a floor at the INPC and a ceiling at the change in Fundeb's nominal revenue; Law 15,437/2026, originating in that MP and considered by a joint committee with Senator Professora Dorinha Seabra as rapporteur, set the floor at R$5,130.63.

Relation to the Lula governments

Shared implementation · Second term (2007 to 2010) · from May 2007 to 2010

On April 2, 2007, the Executive Branch introduced in the Chamber PL 619/2007, which regulated art. 60, item III, subitem e, of the ADCT and set the professional salary floor of teachers at R$850.00 per month, for a workweek of forty hours.[1]

Law No. 11,738 of July 16, 2008, enacted by the National Congress and signed into law by President Luiz Inácio Lula da Silva, was published in the Official Gazette (DOU) on July 17, 2008 and regulates subitem e of item III of art. 60 of the ADCT to establish the national professional salary floor for public basic education teaching professionals.[2]

Law No. 11,738 of 2008 set the floor at R$950.00 per month for secondary-level training, in the Normal modality, as the amount below which the Union, the States, the Federal District and the Municipalities may not set the starting salary of public basic education teaching careers, for a workweek of at most 40 hours; other workweeks have a salary at least proportional.[3]

In the Chamber's Education and Culture Committee, the rapporteur Severiano Alves (PDT-BA) presented an opinion for approval of PL 7,431/06 and PL 619/07, in the form of a substitute bill, approved on October 3, 2007 against the vote of Representative Ivan Valente.[4]

By Message No. 508 of July 16, 2008, the president vetoed item I of art. 3, which provided for an increase of 1/3 of the difference from January 1, 2008; the reasons record that States and Municipalities, through their representative entities, alleged an obligation impossible to comply with, because of art. 169 of the Constitution and, in the case of municipalities, the restrictions of the election year.[5]

On May 27, 2009, the MEC announced that states unable to pay the full amount of the floor, R$950 (for secondary-level professionals with a 40-hour workweek), would receive complementary funds from the Union through Fundeb, by an ordinance to be signed by Minister Fernando Haddad. According to the MEC, nine states already received complementation from the Union through Fundeb; if they were unable to pay the floor even with that portion, they should request the specific complementation from the FNDE and, upon proving the need, would receive the amount in 2010.[6]

According to the MEC, of Brazil's 5,565 municipalities, 29 requested the Union's supplementation provided for in the Floor Law in 2009 and 40 in 2010.[7]

Continued under Lula · Third term (since 2023) · from January 2023 to December 2025

On January 17, 2023, Ordinance No. 17 was published in the Official Gazette (DOU), which established an adjustment of 14.9% in the floor, from R$3,845.63 to R$4,420.55, according to the MEC.[8]

According to the MEC, on Wednesday, January 31, the ministry published in an extra edition of the Official Gazette (DOU) Ordinance No. 61/2024, with a planned increase of 3.62% and a minimum amount of R$4,580.57 for 2024.[9]

Reshaped under Lula · Third term (since 2023) · since January 2026

Law No. 15,326 of January 6, 2026, amended Law No. 11,738 of 2008 to include early childhood education teachers as teaching professionals, regardless of the designation of the position or function, and amended the LDB to define early childhood education teachers.[10]

Provisional Measure No. 1,334 of January 21, 2026, adopted by President Luiz Inácio Lula da Silva, began to provide for annual updating of the floor by act of the Minister of Education by the last business day of January, with a percentage equal to the sum of the previous year's INPC and 50% of the average, over the previous five years, of the real change in revenue from the contribution of States, the Federal District and Municipalities to Fundeb, with a floor at the INPC and a ceiling at the change in Fundeb's nominal revenue.[11]

According to EXM No. 143/2026, under the rule then in force the January 2026 adjustment would have been 0.37%, below the 2025 INPC (3.90%); under the new rule it would be 5.40%, taking the floor from R$4,867.77 to an estimated R$5,130.63, with an estimated impact of R$6.4 billion in 2026 if applied by all federative entities.[12]

Law No. 15,437 of June 18, 2026, originating in MPV 1334/2026, set the floor at R$5,130.63 per month and began to include among teaching professionals those hired for a fixed term.[13]

Law No. 15,437 of 2026 repealed arts. 3 and 4 and § 1 of art. 5 of Law No. 11,738 of 2008, and added art. 4-A, which indicates as sources of financing for the floor, without prejudice to others, those provided for in items I and II and in subitems a and b of item V of the caput of art. 212-A of the Constitution; the law was signed on June 18, 2026 and published in the Official Gazette (DOU) on June 19, 2026.[14]

Shared implementation · Third term (since 2023) · since 2023

According to the joint committee's opinion, the formula of the MPV was developed from discussions in the Permanent Forum for Monitoring the National Teaching Salary Floor Policy, created by the MEC in 2023, with representatives of the Union, the states (Consed), the municipalities (Undime) and the teachers (CNTE).[15]

MPV 1,334/2026 received 34 amendments; the joint committee, installed on May 6, 2026 with Senator Professora Dorinha Seabra as rapporteur, held a public hearing on May 14 with representatives of the MEC, the CNTE, the CNM, Consed, Undime and the National Front of Mayors (Frente Nacional de Prefeitas e Prefeitos).[16]

According to the joint committee's opinion, the FNP requested complementary financial assistance from the Union so that municipalities can comply with the floor adjustment, and the CNM criticized the way the adjustments are defined and the lack of a source of financing, especially of financial support from the Union, warning of the high impact on municipal finances.[17]

Origin and precursors

Origin milestone: founding legal act, Second term (2007 to 2010).

Precursors

  • National Pact for the Valuation of Teaching and the Quality of Education (1994), with a floor of R$300.00 similar initiative, no succession stated by the source According to the Interministerial Statement of Reasons of PL 619/2007 (E.M.I No. 016/MEC/MP), the National Pact for the Valorization of Teaching and the Quality of Education, signed in 1994, set the national teacher salary floor at R$300.00, in 1994 values.[18]

Precursor investigation: new structure established (October 14, 2026).

Scope: EMI No. 016/MEC/MP (2007) with the history of the 1994 Pact; Constitutional Amendment No. 53/2006 (Chamber of Deputies, original publication); PLS 59/2004 and SCD 59/2004 (Senate); records of PL 7431/2006 and PL 619/2007 (Chamber of Deputies); Law No. 11,738/2008 and Veto Message No. 508/2008; page of the rule at the Chamber of Deputies. No earlier federal rule setting a national salary floor for teachers was found; the 1994 pact had no documented normative succession. Law No. 9,394/1996 (LDB) and Law No. 9,424/1996 (Fundef) were not read.

Responsibilities

  • Union (supplementation provided for in the original art. 4, revoked in 2026; supplementation to Fundeb) funding

In the original wording, art. 4 of Law No. 11,738 of 2008 provided that the Union would complement, within the limit of item VI of art. 60 of the ADCT and in regulation, the phase-in of the floor in cases where the entity, considering the funds constitutionally earmarked for education, lacked budget availability, upon a reasoned request to the Ministry of Education with a cost spreadsheet, in addition to technical cooperation from the Union.[19]

  • Municipalities (starting salary, career plans and their own rules) municipal implementation

Law No. 11,738 of 2008 determined that the Union, the States, the Federal District and the Municipalities draw up or adapt their Teaching Career and Compensation Plans by December 31, 2009, with a view to complying with the floor.[20]

  • Supreme Federal Court (STF) (ADI 4167) oversight

At the plenary session of April 27, 2011, the STF judged ADI 4167 unfounded, by majority; as to § 4 of art. 2, it decided that erga omnes effect and binding effect do not apply to the judgment of unfoundedness, with Minister Dias Toffoli recused.[21]

  • Permanent Forum on the salary floor (MEC, Consed, Undime and CNTE) social participation

According to the MEC (2016), the Permanent Forum for Monitoring the Progressive Update of the Value of the National Salary Floor, installed by Minister Aloizio Mercadante, brings together representatives of Consed, Undime, the CNTE and the Ministry of Education to discuss and propose policies for the implementation of Law 11,738 of 2008 by the federative entities.[22]

How it works

Law No. 11,738 of 2008 determines that, in structuring the workweek, a maximum limit of 2/3 of the hours be observed for activities of interaction with students.[33]

The law provided for progressive phase-in of the floor as starting salary: from January 1, 2009, an increase of 2/3 of the difference between the updated floor and the salary in force, and full implementation from January 1, 2010; until December 31, 2009, it was permitted, in restricted cases provided for in the law itself, for the floor to include pecuniary advantages.[34]

Who it serves

Under the original wording of Law No. 11,738 of 2008, public basic education teaching professionals are those who carry out teaching activities or pedagogical support to teaching (educational management or administration, planning, inspection, supervision, guidance and coordination) in basic education school units, with the minimum training required by federal legislation; the provisions on the floor apply to the retirements and pensions covered by art. 7 of Constitutional Amendment No. 41 of 2003 and by Constitutional Amendment No. 47 of 2005.[35]

Changes

Art. 7 of the bill, which classified noncompliance with the law as an act of administrative misconduct (improbidade administrativa), was also vetoed, following a statement by the Ministry of Justice and the Office of the Attorney General (AGU).[36]

Implementation

According to the opinion of the joint committee on MPV 1,334/2026, the year-by-year floor adjustment rates from 2020 to 2026 were 12.84%; 0%; 33.24%; 14.95%; 3.62%; 6.27% and 5.40%, while the INPC changed by 5.45%; 10.16%; 5.93%; 3.71%; 4.77%; 3.90% and 4.17% (the latter projected).[37]

Observed results

A result observed during a term may have causes other than the program.

According to the joint committee's opinion, based on the PNE Technical Assessment (2014 to 2024) published by Inep in December 2025, 16 states paid the floor in effect in 2021, and 60% of municipalities had a base salary equal to or above the 2021 floor.[38]

Limitations

According to the joint committee's opinion (2026), there is no known instance of the complementation mechanism provided for in the original art. 4 having been triggered so as to give rise to support from the Union, and any assistance would have as its source and limit the Union's own complementation to Fundeb; the opinion also records that the mechanism did not become operational.[39]

Context

On October 29, 2008, ADI 4167 was filed at the STF, with the governors of Mato Grosso do Sul, Paraná, Santa Catarina, Rio Grande do Sul and Ceará as petitioners, and the President of the Republic and the National Congress as interested parties.[40]

At the plenary session of February 27, 2013, in judging motions for clarification in ADI 4167, the STF established that Law No. 11,738 of 2008 takes effect from the date of the judgment on the merits, April 27, 2011, and recorded that the action was not entertained as to arts. 3 and 8, because of supervening loss of object.[41]

Origin

Law No. 11,738 of 2008 originated in Senate Bill No. 59 of 2004, authored by Senator Cristovam Buarque (PT/DF), introduced on March 23, 2004, which authorized the Executive Branch to establish the Professional Salary Floor for Public Educators.[42]

In the Senate, PLS 59/2004 was conclusively approved by the Education Committee, without appeal for consideration by the Plenary, and was sent to the Chamber of Deputies on August 23, 2006.[43]

In the Chamber of Deputies, the bill proceeded as PL 7431/2006, originating in PLS 59/2004 and introduced on August 24, 2006, and was transformed into Ordinary Law 11738/2008.[44]
