Special Secretariat for Women's Policies of the Presidency of the Republic (SPM), later Secretariat for Women's Policies (2010) and Ministry of Women (2023)

Also known as State Secretariat for Women's Rights (Ministry of Justice, 2002), Special Secretariat for Women's Policies (Ministry of Women, Racial Equality, Youth and Human Rights, 2016; Ministry of Justice and Citizenship, 2016 to 2017), National Secretariat for Women's Policies (Government Secretariat of the Presidency, 2017; Ministry of Women, Family and Human Rights, 2019 to 2022).

Problem
To formulate, coordinate, and articulate women's policies in the federal government. Before 2003, the promotion of policies to eliminate discrimination against women was the responsibility of the National Council on Women's Rights, created by Law No. 7,353/1985 with permanent channels of relationship with the women's movement; in 2002, Law No. 10,539 created the State Secretariat for Women's Rights within the Ministry of Justice.
Who it serves
Women, through policies coordinated with other ministries, with the National Council on Women's Rights and, since 2007, with state and municipal women's policy bodies on the monitoring committee of the National Plan.
How it works
MP No. 103/2003, converted into Law No. 10,683/2003, transformed the State Secretariat for Women's Rights into the Special Secretariat for Women's Policies, a body of the Presidency of the Republic whose head had prerogatives equivalent to those of a minister, and transferred the CNDM to it. The Secretariat was responsible for advising the President on the formulation, coordination, and articulation of women's policies, and for preparing gender planning and national educational and anti-discrimination campaigns. A 2003 decree placed under the coordination of the Secretariat and the CNDM the 1st National Conference on Women's Policies, scheduled for 2004, to propose guidelines for the National Plan of Policies for Women, approved by Decree No. 5,390/2005 and monitored by a committee coordinated by the Secretariat. In 2010 it became the Secretariat for Women's Policies; in 2016 it was abolished as a body of the Presidency, and the area became a secretariat of other ministries; Law No. 14,600/2023, the conversion of MP No. 1,154/2023, kept the creation of the Ministry of Women.

What was established

Law 14,600/2023 included the Minister of State for Women among the positions of Minister of State.[26]

How it works

Decree of July 15, 2004 established an Interministerial Working Group to prepare the National Plan of Policies for Women in accordance with the priorities of government planning and the guidelines of the 1st National Conference on Women's Policies.[27]

The annex to Decree 5,390/2005 organized the objectives of the 1st PNPM into five blocks: autonomy, equality in the world of work, and citizenship; inclusive and non-sexist education; women's health, sexual rights, and reproductive rights; confronting violence against women; and management and monitoring of the Plan.[28]

Governance

MP 103/2003 required the Secretariat to set up, within ninety days, a working group made up of representatives of the Secretariat and of society to prepare a proposal for regulating the National Council on Women's Rights.[29]

Decree 6,412/2008 assigned to the CNDM the task of participating in the organization of the national conferences on public policies for women.[30]

Budget and spending

Figures are nominal unless stated otherwise. Announced, authorized, committed, liquidated and paid amounts are different things and appear with the type indicated. In SIOP lines, "paid" means paid within the same fiscal year (arrears settled later are not counted), and one budget action can fund more than one program: the text says when the action is only part of a program.

According to Ipea (2008), the SPM's resources totaled R$13.48 million in the 2007 Ploa (draft annual budget bill) and rose to R$42.85 million with the amendments approved in the National Congress, a figure that practically equals the 2008 Ploa; according to Ipea, this initial increase is due to the launch of the National Pact to Confront Violence against Women. Ipea also notes that the volume of frozen resources remained very high: as of early December 2007, only 58% of the total approved in the 2007 LOA had been made available for use and commitment.[31]

In 2004, budget unit 20122 (Special Secretariat for Women's Policies) had an initial appropriation of R$26,192,020, authorized (law plus credits) of R$24,867,020, and paid in the fiscal year of R$14,815,597, according to SIOP.[32]

In 2007, budget unit 20122 (Special Secretariat for Women's Policies) had an initial appropriation of R$48,429,938, authorized of R$48,799,938, and paid in the fiscal year of R$24,757,394, according to SIOP.[33]

In 2015, budget unit 65101 (Secretariat for Women's Policies) had an initial appropriation of R$260,387,406, authorized of R$266,413,888, committed of R$144,962,097, and paid in the fiscal year of R$71,194,339, according to SIOP.[34]

In 2018, budget unit 20122, then called the National Secretariat for Women's Policies, had an initial appropriation of R$114,810,299, authorized of R$70,571,405, and paid in the fiscal year of R$38,511,554, according to SIOP.[35]

According to Ipea (citing Tokarski et al., 2022b), the 2nd PNPM had a nominal investment of about R$7 billion in actions specific to women and more than R$10 billion in universal actions; the first PNPM had no budget commitment for the actions and the sectoral bodies.[36]

In 2023, budget unit 65101 (Ministry of Women, Direct Administration) had no initial appropriation of its own; the authorized amount was R$149,006,993, the committed amount R$147,124,619, and the amount paid in the fiscal year R$27,206,726, according to SIOP.[37]

In 2025, budget unit 65101 (Ministry of Women) had an initial appropriation of R$370,538,893, authorized of R$314,305,842, committed of R$300,271,912, and paid in the fiscal year of R$118,300,787, according to SIOP.[38]

Limitations

According to Ipea (2008), the evaluation carried out at the 2nd CNPM pointed to progress (greater incorporation of gender mainstreaming, greater inclusion of gender, race, and ethnicity in the budget and in planning, expansion of the women's rights councils) and to obstacles, such as the low publicity of the PNPM and actions and guidelines not yet translated into budget terms.[39]

According to Ipea (2011), the National Plans of Policies for Women sought to translate the federal government's policies for women, but were not fully implemented, and many of their actions were difficult to monitor.[40]

According to Ipea (2022), many of the concrete actions planned for the area of confronting violence against women, even those considered priorities, such as the Casa da Mulher Brasileira (Brazilian Women's House), were unable to have their budget executed.[41]

Context

According to Ipea (2011), MP 483/2010, converted into Law 12,314/2010, gave four secretariats of the Presidency, among them the Secretariat for Women's Policies, ministry status, with a structure more similar to that of a ministry and a seat on the Council for Economic and Social Development.[42]

For Ipea (2022), the symbol of a new moment was the merger of the SPM with other secretariats into an umbrella ministry, followed, from 2016 on, by successive losses of institutional relevance, of budgets, and of the importance of the issue on the political agenda.[43]

Precursors

Under Law 7,353/1985, the CNDM was responsible for formulating guidelines and promoting policies at all levels of public administration aimed at eliminating the discrimination that affects women, and for maintaining permanent channels of relationship with the women's movement; one third of the Deliberative Council would be chosen from among persons nominated by women's movements.[44]
